FixBox Repair Terms and Conditions
By ordering service work on the customer's device (Device) Customer authorizes FixBoxRepair to perform the work on the customer's device and agrees with the following Terms and Conditions:
FixBoxRepair Responsibilities & Limited Warranty:
1.FixBoxRepair offers to Customer free estimate on site. Customer may bring the device to the office personally or get it delivered by mail. All shipping costs will be borne solely by the purchaser. FixBoxRepair engineers will check the Device upon receiving and provide Customer with the Service Estimate. Service on Device will not begin unless and until Customer authorize the Service Estimate amount. If FixBoxRepair specialists determine on further inspection additional issues with Device additional charges not shown in the Service Estimate may apply. In that case, FixBoxRepair will notify Customer of the additional charges prior to starting work on Device. Service Device will not begin unless and until Customer authorize the additional costs.
2. The limited warranty will cover all repairs made by FixBoxRepair for a period of ninety (90) days. If Device malfunctions during the limited warranty period, it must be returned to the FixBoxRepair service center for evaluation personally or by mail. All shipping costs will be borne solely by the purchaser. FixBoxRepair engineers will diagnose the repair upon receipt. If diagnostic shows problems with the Device that is connected to the Service provided by FixBoxRepair, Device would be repaired or replaced at no charge. This warranty does not apply to defects resulting from any action of Customer or other parties, including but not limited to mishandling, physical damage, water damage, improper interfacing, operation outside of design limits, improper repair by someone other than FixBoxRepair, as well as any operation conditions outside of FixBoxRepair control such as excessive corrosion, current, heat, moisture, vibration, etc. FixBoxRepair employees reserve the right to VOID this warranty if any improper repairs or modifications have been made to the Device after the Customer has left the FixBoxRepair location.
3. Unless otherwise required by law, all replaced devices, parts, components, boards, and equipment will become the property of FixBoxRepair, and Customer waives all rights Customer may have under state or other laws to the replaced Device or repaired or replaced parts.
4. FixBoxRepair may use rebuilt, reconditioned, or new parts, and components when repairing Device.
5. FixBoxRepair will be responsible to the extent provided under applicable law for the physical safekeeping of Device while in FixBoxRepair's possession for Service. If Device is lost or damaged while it is in FixBoxRepair's possession for Service, FixBoxRepair will repair or replace it with an equivalent device, which at FixBoxRepair's option may be new or refurbished.
6. If Customer fails to pick up Device or otherwise arrange for its return after FixBoxRepwir efforts to contact you, after forty-five (45) days following the completion of repairs, FixBoxRepair will treat the device as abandoned. It means FixBoxRepair may dispose of the property in its sole discretion following applicable law provisions, including sale to recoup administrative and repair costs.
Data on Device:
The Customer is solely responsible for backing up any data on Device and deleting, encrypting, or otherwise protecting your data from unauthorized use. FixBoxRepair will not back up or restore data from the device before the repair and is not responsible for any lost or corrupted data. Additionally, FixBoxRepair will not treat data on Device as confidential and disclaims any agreement with the Customer or other obligation to do so.
In particular, if the Warranty Status of Your Device shown on the front of this Service Authorization is "In Warranty" and FixBoxRepair determines on further inspection that the issue with Your Device is not covered by the Limited Warranty (for example, there is mechanical or water damage), then additional charges not shown in the Service Estimate may apply. In that case, FixBoxRepair will notify you of the additional charges prior to starting work on your device. Service on Your Device will not begin unless and until you authorize the additional costs.
LIMITATION OF LIABILITY/INDEMNITY:
THE LIMITED WARRANTY STATED ABOVE SETS OUT THE FULL EXTENT OF FIXBOXREPAIR'S RESPONSIBILITIES, AND THE EXCLUSIVE REMEDY REGARDING WORK PERFORMED OR PARTS SUPPLIED BY UBREAKIFIX IN CONNECTION WITH THE SERVICE ON YOUR DEVICE. ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THE LIMITED WARRANTY. IN NO EVENT WILL FIXBOXREPAIR BE LIABLE FOR DAMAGES ABOVE THE TOTAL AMOUNT DUE FOR THE SERVICE, INCLUDING WITHOUT LIMITATION, COMMERCIAL LOSS OF ANY SORT; LOSS OF USE, TIME, DATA, REPUTATION, OPPORTUNITY, GOODWILL, PROFITS OR SAVINGS; INCONVENIENCE; INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES; OR DAMAGES ARISING FROM THE USE OR INABILITY TO USE THE PRODUCT. SOME STATES AND JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE DISCLAIMER OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THESE LIMITATIONS AND DISCLAIMERS MAY NOT APPLY TO YOU. UBREAKIFIX IS NOT LIABLE FOR ANY FAILURE OR DELAY IN PERFORMANCE TO THE EXTENT CAUSED BY CIRCUMSTANCES BEYOND ITS REASONABLE CONTROL. YOU AGREE TO INDEMNIFY FIXBOXREPAIR FROM AND AGAINST ANY CLAIMS BROUGHT AGAINST IT ARISING FROM YOUR BREACH OF APPLICABLE LAW OR THESE TERMS AND CONDITIONS.
No Modification:
No agent, employee, dealer, representative, or reseller is authorized to modify these Terms and Conditions, extend the Limited Warranty above, or make binding representations or claims, whether in advertising, presentations or otherwise, on behalf FixBoxRepair regarding the Service.
Severability
Customer and FixBoxRepair agree that we intend to enforce these Terms and Conditions under their terms to the fullest extent permitted by law. Customer and FixBoxRepair agree that if a court or arbitrator adjudges any portion of these Terms and Conditions to be invalid or unenforceable, adjudication will not invalidate the remainder of these Terms and Conditions, they will be fully enforceable.
Entire Agreement
To the extent permitted by applicable law, these Terms and Conditions state all terms agreed by the parties and supersede all other agreements relating to its subject matter.
Meta - Data
You understand and agree FixBoxRepair will collect Meta - Data logs during diagnostic evaluation to improve the overall future functionality of the diagnostic tool and symptom evaluation in the repair process. The data collected will be used solely by FixBoxRepair to enhance and improve this process, may be shared with FixBoxRepair affiliates, and will not be distributed further without your consent. Data types that may be collected from your device include the device phone number, device model number, device IMEI, device serial number, downloaded applications & their respective settings, and host applications & their respective settings.
Personal information
Personal information that you provide while registering as a client of FixBoxRepair (such as your name, telephone number, email, mailing address, etc.) will be used to fulfill the Service you have requested. FixBoxRepair will not sell, rent, or otherwise disclose such information (except as needed to FixBoxRepair service vendors) without your consent.
